on the Procedure for Conducting Tests in Cases of Suspected Consumption of Alcoholic Beverages or Other Addictive Substances by Students

Article 1
Introductory Provisions

1. This measure establishes the procedure for determining the presence of alcohol or other addictive substances in students of the Faculty of Science of the University of South Bohemia in České Budějovice (hereinafter referred to as the “student”).
2. The purpose of this measure is to protect the life and health of students and other persons, as well as to protect property and ensure the safe conduct of teaching, laboratory work, field exercises, excursions, professional placements, sports activities, and other activities.

Article 2
Prohibition of the Consumption of Alcohol and Other Addictive Substances

1. A student must not consume alcoholic beverages or use other addictive substances before or during activities in which they could endanger their own life or health or that of others, damage university property or the property of third parties, or harm the good reputation of the university.

2. The prohibition under paragraph 1 applies to all teaching and other activities related to the student’s studies or presence at the university. Such activities include, in particular:
a) lectures, seminars, and classes;
b) laboratory work;
c) work in workshops and specialized facilities;
d) work with chemical, biological, or radioactive substances;
e) work with machinery and technical equipment;
f) field instruction;
g) professional placements and internships;
h) excursions;
i) sports and physical education activities;
j) participation in conferences, workshops, and other academic events organized by the university or faculty; k) other activities related to the student’s studies or presence at the university.

3. A student is obliged to comply with the instructions of teachers, activity leaders, and other authorized persons issued to ensure occupational health and safety; to immediately report any facts that may affect the safe conduct of teaching or other activities; and not to endanger their own health or the health of others through their actions.

Article 3
Authorized Persons

1. The authorized persons who may order a screening test for the presence of alcohol or another addictive substance are:
a) teachers;
b) academic staff, researchers, and other employees of the University of South Bohemia, or external collaborators of the university supervising instruction;
c) heads of departments or units;
d) persons authorized by the Dean or the head of a department or unit.

Article 4
Procedure in Cases of Suspected Consumption of Alcohol or Another Addictive Substance

1. If there is reasonable suspicion that a student has consumed alcohol or another addictive substance, an authorized person may order the student to immediately cease participation in classes or any other activity referred to in Article 2(2) of this measure.
2. If there is reasonable suspicion that a student has consumed alcohol or another addictive substance, an authorized person has the right to request that the student undergo a screening test using an appropriate detection device.
3. Upon request, the student is obliged to undergo a screening test for alcohol or addictive substances using an appropriate detection device.
4. The screening test shall be conducted in the presence of at least one witness.
5. A written report on the course and result of the test shall be prepared, containing in particular:
a) identification of the student;
b) the date, time, and place of the test;
c) identification of the measuring device or test kit used;
d) the test results;
e) the student's statement;
f) identification and signatures of the authorized person and witnesses.
6. If the student has doubts about the accuracy of the result, the alcohol screening test may be repeated after at least 15 minutes have elapsed. During this period, the student must not eat, drink, or smoke.
7. If the circumstances of the case so require, if doubts arise regarding the result of the screening test, if the screening test is positive, or if there are reasonable doubts about the student's medical fitness, the authorized person may request that the student undergo a professional medical examination or arrange for such an examination, including the collection of biological samples.

Article 5
Refusal to Undergo Testing

1. If a student refuses to undergo a screening test or a professional medical examination, the authorized person shall order the student to cease participation in any of the activities listed in Article 2(2) of this regulation.
2. The refusal to undergo testing shall be recorded in the report.
3. Refusal to undergo testing may be considered a violation of the student's obligations under legal regulations and the internal regulations of the university and faculty and may constitute grounds for initiating disciplinary proceedings.

Article 6
Further Procedure

1. If a screening test or professional examination confirms the presence of alcohol or another addictive substance, or if the student refuses testing, the authorized person is obliged to:
a) immediately order the student to cease participation in the activity;
b) inform the head of the relevant department or unit;
c) refer the matter to the Dean or a person designated by the Dean for further action.
2. The student's conduct may be assessed as a disciplinary offence under the Higher Education Act and the Disciplinary Code of the Faculty of Science of the University of South Bohemia.
3. If a student's participation in an activity has been terminated under paragraph 1, the student shall arrange and pay for their return at their own expense unless the activity leader decides otherwise.
4. Documentation related to the investigation shall be processed and stored by the Student Affairs Office in accordance with personal data protection legislation and the relevant internal regulations of the university.

Article 7
Final Provisions

1. Upon the effective date of this measure, the Dean’s Measure of the Faculty of Science of the University of South Bohemia dated 18 February 2008 is repealed.
2. This measure shall enter into force and take effect on the date of signature.
